AUTHOR Right to Ownership
The
AUTHOR grants ANOINTED WORD MEDIA GROUP limited, nonexclusive rights to print
and distribute the Work. ANOINTED WORD MEDIA GROUP acquires no right of
ownership to the Work under this agreement and the AUTHOR shall own full and
complete copyright to the Work.
Term and Termination
The
AUTHOR may cancel this agreement at any time in writing, by letter (See
"Notices" below.) The AUTHOR may enter into another publishing
agreement for this Work at any time. If manuscript files have been
supplied, ANOINTED WORD MEDIA GROUP, shall not, refund to the AUTHOR any
portion of the submission fee in the event the AUTHOR cancels this agreement or
enters into another agreement for this Work.
If the AUTHOR has NOT
submitted any manuscript files to ANOINTED WORD MEDIA GROUP a refund shall be
given in the following increments: 75% credit or refund (if terminated in 30
days or less) 50% refund (if terminated between 31 and 60 days) 25% credit or
refund (if terminated between 60 and 90 days) No credit or refund after 90
days.
ANOINTED WORD MEDIA GROUP Submission Acceptance and
Reservation
ANOINTED
WORD MEDIA GROUP reserves the right to refuse or to assign an alternate imprint
to works that contain: offensive material, libelous statements, graphic sexual
content, graphic violence, profanity, content that is not consistent with
traditional Christian belief and practice, or content that infringes on the
copyright of another. ANOINTED WORD MEDIA GROUP may also cancel this agreement
if, after submission, the work is found to contain such material. Should
ANOINTED WORD MEDIA GROUP cancel this agreement on these grounds, AUTHOR may
qualify to receive a partial refund of submission fees. As such, these books
shall not be marketed or promoted in any way under the ANOINTED WORD MEDIA
GROUP name and/or logo.
Distribution
ANOINTED
WORD MEDIA GROUP intends to prepare the Work for distribution within ninety
(90-120) days of the date of this Agreement, but the AUTHOR acknowledges that
the production process may exceed that time period due to circumstances beyond
its control or in the event the AUTHOR makes excessive changes to the
manuscript after it has been submitted. AUTHOR should NOT schedule book
signings or other special promotions until they have their printed books in
hand.
ANOINTED WORD MEDIA
GROUP will make AUTHORs book available on a national level through our
partnerships with Midpoint Trade Books. The AUTHOR understands that he or
she is responsible for the printing costs of books ordered by the
distributor. The distribution process will be as follows: The
distributor will place an order with ANOINTED WORD MEDIA GROUP, once the
order has been placed an acquisitions manager from ANOINTED WORD
MEDIA GROUP will contact AUTHOR with the invoice. The
AUTHOR then must verify if he or she can fill the order (if author is unable to
fill the order in full, he or she may give a quantity that they are able to
supply) and submit payment to ANOINTED WORD MEDIA GROUP for the printing and
shipping of books. ANOINTED WORD MEDIA GROUP will then have books
printed and shipped to the distributor.
AUTHOR understands that
sales from books ordered by the distributor are not guaranteed, and books may
be returned for non-sale. AUTHOR understands that he or she assumes
responsibility for the return of unsold books. AUTHOR understands that
royalties from books ordered through distributor will be supplied once they
have been received by ANOINTED WORD MEDIA GROUP and that payment from the
distributor may take up to 120 days.
AUTHOR Warranties
The
AUTHOR guarantees he/she is the sole owner of the Work and has the full
authority and right to enter into this agreement. The AUTHOR guarantees the
Work is original and does not infringe upon any laws or rights, and that the
Work is not libelous, plagiarized, or in any other way illegal. If any portion
of the Work is fictitious, the AUTHOR guarantees it does not represent any real
event or person in a way that could be deemed libelous. ANOINTED WORD MEDIA
GROUP assumes no responsibility for reviewing the editorial content of the
Work.
AUTHOR Indemnification
The
AUTHOR agrees to fully indemnify, defend and hold harmless ANOINTED WORD MEDIA
GROUP., its employees, owners, and/or its affiliates against all manner of
claims, losses, damages, judgments, settlements, or expenses (including
attorney’s fees) it sustains in connection with any breach or alleged breach of
the representations set forth above, or in connection with claims by any third
party regarding ownership, libel, slander, plagiarism, or privacy. ANOINTED
WORD MEDIA GROUP reserves the right to cancel this agreement if breached by the
AUTHOR.
Express Publishing Package
The
AUTHOR understands that at least one hundred percent (100%) of the publishing
package and services ordered is due at the signing of this agreement.
Terms of
AUTHOR
are given a 60%-65% discount on all first time orders (The AUTHOR is required
to order a minimum of 100 books for the first order.) If author opts to
purchase less than 100 books, author will receive regular discounts of
40%-45%. The minimum order requirement is 50 books; Free books are
shipped with authors first order. Orders must be paid for with money
order, or credit card at the time the order is placed. Retail prices and
discounts are posted on the ANOINTED WORD MEDIA GROUP web site and are subject
to change. The AUTHOR may not cancel or otherwise alter an order after it has
been placed.
Royalties
ANOINTED
WORD MEDIA GROUP. shall pay the AUTHOR a royalty for each copy sold. AUTHOR
shall receive 100% of net sales from bookstores, and 75% from all other sales.
Net receipts are defined as the total amount of money ANOINTED WORD MEDIA GROUP
receives for sales, minus manufacturing costs. Manufacturing costs are
defined as printing costs, taxes, shipping charges, & returns. AUTHOR shall
receive no royalties on copies they purchase. Royalties are paid
quarterly, within 45 days after the end of March, June, September, and
December. If a royalty payment is less than $25.00, ANOINTED WORD MEDIA GROUP
reserves the right to hold the amount until the next royalty period.
Cover Design
ANOINTED
WORD MEDIA GROUP WILL NOT design a book cover under the Anointed Express
Program. Author understands that he or
she is responsible for submitting a press ready book cover designed according
to our PDF specifications. Failure to
submit files in the correct specifications will result in a delay in the book
production, and the author will be advised to resubmit files.
Text Format
ANOINTED
WORD MEDIA GROUP WILL NOT design the interior files under the Anointed Express
Program. Author understands that he or
she is responsible for submitting a press ready interior file designed
according to our PDF specifications. Failure to submit files in the
correct specifications will result in a delay in the book production, and the
author will be advised to resubmit files
Miscellaneous Fees
AUTHOR
agrees to submit his/her manuscript in complete and final form (already edited,
copyedited, and proofread). AUTHOR who choose ANOINTED WORD MEDIA GROUP
copyediting services will submit their manuscript in complete and final form
when copyedit is complete. The AUTHOR acknowledges the ANOINTED WORD MEDIA GROUP
may assess “change fees†for AUTHOR-requested text changes after AUTHOR have
submitted their manuscript in complete and final form. Changes can be made to
covers for a fee. Fees are subject to change at any time.
ANOINTED WORD MEDIA GROUP. Discretion & Publications
ANOINTED
WORD MEDIA GROUP intends to publish the work within fourteen (14) days after
receipt of all required materials relating to the WORK. The format and appearance of the Work may
vary between printings. Retail prices are subject to change; we will allow an
increase of up to $1 USD and 1 GBP per annum.
Damage or Loss of Materials
ANOINTED
WORD MEDIA GROUP shall endeavor to care for and return any disks, manuscripts,
photographs, or artwork but is not responsible for any damage or loss.
Notices
All
notices to ANOINTED WORD MEDIA GROUP must be sent in writing (by letter) to its
office at
Complete Agreement
This
written Agreement contains the sole and entire Agreement between the parties
and shall supersede any and all other prior agreements between the parties.
This Agreement may not be modified or amended except in writing signed by the
party against whom such modification or amendment is sought to be enforced.
Law and Venue
The
parties understand this agreement is binding upon their heirs, executors,
administrators, and assigns. The laws of the State of
